Terms & Conditions / Inspection Agreement

Effective Date: April 6, 2026

This Inspection Agreement (“Agreement”) is entered into by and between JCM Home Inspections LLC (“Inspector”) and the client (“Client”) for the purpose of performing a home inspection at the requested property.

1. Scope of Inspection

The inspection is a non-invasive, visual examination of the readily accessible areas of the property at the time of the inspection.

The inspection is performed in general accordance with the New York State Standards of Practice. It is not technically exhaustive and does not identify all existing or potential defects.

2. Limitations

The inspection does not include:

  • Hidden or concealed defects

  • Code compliance or regulatory compliance

  • Environmental hazards (unless specifically added), including but not limited to:

    • Mold

    • Radon

    • Asbestos

  • Pests/wood-destroying organisms (unless added as a separate service)

  • Future conditions or life expectancy of systems

3. Inspection Report

A written report will be provided following the inspection.

The report:

  • Reflects conditions at the time of inspection only

  • Is intended for the sole use of the Client

  • Should not be relied upon by third parties without written consent

4. Client Responsibilities

The Client agrees to:

  • Provide access to the property and all necessary areas

  • Attend the inspection when possible

  • Read the full report and ask questions if clarification is needed

5. Fees & Payment

Payment is due prior to or at the time of inspection, unless otherwise agreed.

Failure to make payment may result in withholding of the inspection report.

6. Limitation of Liability

To the fullest extent permitted by law, the liability of JCM Home Inspections LLC and its inspector(s) is limited to the amount of the inspection fee paid.

The Client agrees that this limitation is a reasonable allocation of risk.

7. Dispute Resolution

Any dispute arising from this inspection shall be resolved through:

  • Good faith negotiation first

  • If unresolved, mediation or arbitration may be pursued prior to legal action

8. Time Limitation for Claims

Any claim arising from the inspection must be made within one (1) year from the date of the inspection.

9. No Warranty or Guarantee

The inspection and report are not a warranty or guarantee of any kind, expressed or implied, regarding the condition of the property.

10. Add-On Services

Additional services (such as radon testing, mold inspection, etc.) are only included if specifically requested and agreed upon.

Each add-on service may have its own separate terms and limitations.

11. Governing Law

This Agreement shall be governed by the laws of the State of New York.

12. Acceptance of Terms

By scheduling and/or proceeding with the inspection, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions.
